N.J.S.A. 39:4-49.1 CDS in a Motor Vehicle Charge Dismissed

Possession of marijuana, or any controlled dangerous substance for that matter, is a criminal offense. However, in addition to any possession charges under N.J.S.A. 2C:35-10, you may also be charged with possession of a CDS in a Motor Vehicle if, as you may have guessed, you were in a motor vehicle at the time of the arrest or the drugs were in a motor vehicle at the time of the arrest. As you or may not be aware, Speeding (N.J.S.A. 39:4-98) and Reckless Driving (N.J.S.A. 39:4-96) tickets often go hand-in-hand. If you are caught driving at a high rate of speed (101 MPH in a 65 MPH zone for instance), then the officer may, in addition to a Speeding ticket, issue you a traffic ticket for Reckless Driving based on the fact that your high rate of speed demonstrated a "willful or wanton disregard of the rights or safety of others, in a manner so as to endanger, or likely to endanger, a person or property." Today, I resolved a traffic ticket matter for a Middlesex County commuter charged with Reckless Driving by having the charge dismissed completely. The client ended up owing the court nothing in terms of fines or penalties, and did not have any violation added to the client's driver's abstract.
