N.J.S.A. 39:3-10, Unlicensed Driver Ticket Mandatory Six Month Suspension Downgraded

Pursuant to N.J.S.A. 39:3-10:

No person shall drive a motor vehicle on a public highway in this State unless the person is under supervision while participating in a behind-the-wheel driving course pursuant to section 6 of P.L.1977, c. 25 (C.39:3-13.2a) or is in possession of a validated permit, or a probationary or basic driver’s license issued to that person in accordance with this article.

Should you not currently possess, not have ever previously possessed a valid license in this State or any other State of this country, the court shall impose a mandatory six (6) suspension of your driving privileges. The concern here is that should you subsequently be caught Driving While Suspended, under N.J.S.A. 39:3-40, you will be facing mandatory jail time in certain instances. Recently, our office assisted an individual charged with being an Unlicensed Driver, under N.J.S.A. 39:3-10(b), in a Monmouth County shore town.  My client had never owned or obtained a driver’s license here in the United States and was technically not a legal resident at the time.
